Who provides the finance

Baank Pty Ltd holds Australian Credit Licence No. 123456 and is the party responsible for the credit or finance you may be offered. Baank Pty Ltd assesses your circumstances, discusses the finance options available to you, arranges the finance, and explains all applicable interest rates, fees, charges, terms and conditions.

What EarthMoving Finance does — and does not — do

EarthMoving Finance (ABN 52 452 030 694) operates this website as a marketing and referral service only. We act as a referrer under the referrer exemption in regulation 25 of the National Consumer Credit Protection Regulations 2010 (Cth). This means:

• We are not the credit provider and do not lend money.
• We do not arrange or provide the finance ourselves.
• We do not give credit advice and do not make any recommendation about whether a finance product is suitable for you.
• We do not assess your application, approve or decline finance, or set interest rates, fees or terms.
• Our role is limited to collecting your enquiry details and passing them to Baank Pty Ltd, who will contact you directly.

The commission arrangement

EarthMoving Finance has a commercial referral arrangement with Baank Pty Ltd. We are paid a commission or referral fee by Baank Pty Ltd for enquiries referred through this website. The fee may be payable on referral of your enquiry or on settlement of finance, and is paid by Baank Pty Ltd — not by you. You are not charged any fee by EarthMoving Finance for submitting an enquiry.

This arrangement means we have a financial interest in you submitting an enquiry, and we receive the commission whether or not the finance ultimately suits you. Any fees, charges or commissions payable in connection with the finance itself will be disclosed to you directly by Baank Pty Ltd before you enter into any credit contract.

How your personal information is shared

When you submit an enquiry, you consent to EarthMoving Finance disclosing your personal information to Baank Pty Ltd for the purpose of your finance enquiry, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. The information disclosed typically includes:

• Your name, email address and phone number.
• Your business details, including business name and ABN where provided.
• Your equipment and finance requirements — asset type, make and model, purchase price, condition, deposit, and any existing finance details you give us.

Baank Pty Ltd will contact you by phone, email or SMS about your enquiry, and handles your personal information in accordance with its own privacy policy and licence obligations. Once your information has been disclosed to Baank Pty Ltd, their handling of it is governed by their privacy policy rather than ours.
